1. Agreement
By downloading, installing, or using the Stak mobile application (the "App") or the website at thestakapp.com (the "Site"), you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the App or the Site.
The App and Site are operated by The Stak App ("we", "our", "us"). You must be at least 17 years old to use Stak.
2. What Stak is and isn't
Stak is a personal tracking tool for logging peptides, GLP-1 medications, protein, calories, and related wellness data. It is intended for general informational and self-tracking purposes only.
Stak is not a medical device. It does not provide medical advice, diagnosis, dosing guidance, or treatment recommendations. You must consult a licensed healthcare professional for any medical decision. Do not start, stop, or change any medication, peptide, or treatment based on the App. In an emergency, call your local emergency number.
3. Your account
You're responsible for keeping your account credentials secure and for the activity on your account. Tell us at support@thestakapp.com right away if you suspect unauthorized access.
4. Subscriptions (auto-renewing)
Stak offers optional auto-renewing subscriptions purchased through the Apple App Store. The following terms are required by Apple and apply to all subscriptions:
- Length and price. Subscription length and price are displayed in the App before you confirm purchase. Current options include monthly and annual plans, with prices shown in your local currency.
- Payment. Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-renewal. Subscriptions automatically renew at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours of the end of the current period at the price of the selected plan.
- Managing or cancelling. You can manage your subscription and turn off auto-renewal in your Apple ID account settings on your device (Settings → [your name] → Subscriptions). Deleting the App does not cancel the subscription.
- Free trials. If a free trial is offered, any unused portion of the trial period is forfeited when you purchase a subscription, where applicable.
- Refunds. Refunds are handled by Apple per the App Store policy. We cannot issue refunds directly for App Store subscriptions. Request a refund at reportaproblem.apple.com.
- Price changes. If we change the price of a subscription, we will give you notice and an opportunity to cancel before the new price takes effect, as required by Apple.
5. Acceptable use
You agree not to:
- Use Stak for any unlawful purpose or in violation of any law
- Reverse engineer, decompile, or attempt to extract source code, except where allowed by law
- Resell, sublicense, or otherwise commercially exploit access to the App
- Interfere with the operation of the App or attempt to bypass security controls
- Use the App to provide medical advice to others or as a substitute for clinical care
6. Your content
You retain ownership of the data and content you enter in the App ("Your Content"). You grant us a limited licence to host and process Your Content solely to provide the App's features to you (for example, sync, backup, or export). We do not use Your Content to train models or for advertising. See our Privacy Policy for details.
7. Intellectual property
The App, the Site, and all related software, designs, logos, and content (other than Your Content) are owned by The Stak App or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes, subject to these Terms.
8. Third-party services
The App may interoperate with third-party services such as the Apple App Store, Apple Health, and our cloud providers. Your use of those services is governed by their terms, not ours.
9. Disclaimers
The App and Site are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any data will be accurate or complete. Nothing in the App is medical advice.
10. Limitation of liability
To the maximum extent permitted by law, The Stak App, its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of the App. Our total cumulative liability for any claim related to the App will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) CAD $50.
11. Indemnification
You agree to defend and indemnify The Stak App from any third-party claim arising out of your breach of these Terms or your misuse of the App, except to the extent the claim arises from our negligence or wilful misconduct.
12. Termination
You may stop using the App at any time and delete your account in Settings. We may suspend or terminate access if you materially breach these Terms or use the App in a way that creates risk for us or other users.
13. Changes to the App or these Terms
We may update the App and these Terms over time. For material changes to these Terms, we will notify you in the App or by email before the change takes effect. Continued use after a change means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable there, without regard to conflict of laws rules. Disputes will be resolved in the courts of Ontario, unless your local consumer protection laws provide otherwise.
